CVA(LOCAL) - FACILITIES CONSTRUCTION: COMPETITIVE BIDDING
The Superintendent or designee shall ensure that detailed specifications are prepared for any construction project for which competitive bids are sought.
All bids shall be submitted in sealed envelopes, plainly marked with the name of the bid and the time of the bid opening. Bids shall be opened at the time specified. All interested parties shall be invited to attend the bid opening. Any bid may be withdrawn prior to the scheduled time for opening. Bids received after the specified time shall not be considered.
In determining responsibility, the District shall consider, in addition to the factors stated in law:
The experience record of the bidder or proposer in having performed satisfactorily, within a stated time schedule, contracts for work of a similar nature and scope;
The record of timeliness of the bidder or proposer in meeting financial obligations to subcontractors, material men, and employees;
The adequacy of plant equipment available to the bidder or proposer to execute such work properly and expeditiously; and
Necessary financial resources accessible to the bidder or proposer to meet the obligations incident to the work.
The ability of any bidder or proposer to obtain a performance bond shall not be regarded as the sole qualification of the bidder or proposer's competency and responsibility.
If the District considers the safety record of bidders in determining to whom to award a contract, the safety record shall be defined as:
A bidder's Occupational Safety and Health Administration (OSHA) 300 logs for the last three years,
A loss analysis provided by the bidder's insurance carrier or insurance agent covering the bidder's workers' compensation insurance coverage (loss run),
A loss ratio provided by the bidder's insurance carrier or insurance agent covering the bidder's workers' compensation insurance coverage, and
The bidder's current experience modifier from the bidder's workers' compensation insurance premiums provided by the bidder's insurance carrier, insurance agent, or rating agent.
