Compliance with Law and Authority to Sign Contracts

The Superintendent shall establish procedures that ensure that all school facilities within the District comply with applicable laws and local building codes.

All contracts shall be signed by the Superintendent or designee.

For construction contracts valued at or above $50,000, the Superintendent shall also submit an agenda item to the Board for approval. Lesser expenditures for construction and construction-related materials or services shall be at the discretion of the Superintendent and consistent with law and policy. Competitive Procurement Requirements

The purchase of construction services shall be submitted to a competitive procurement process, as defined in CH, when the aggregate purchase will total $50,000 or more over a 12-month period. Purchases of this magnitude shall be processed by the purchasing office. [See also CBB(LEGAL)]

Project Administration

All construction projects shall be administered by the Superintendent or designee.

The Superintendent shall keep the Board informed concerning construction projects and also shall provide information to the general public.

Final Payment

The District shall not make final payments for construction or the supervision of construction until the work has been completed and the District has accepted the work.

Change Orders

Change orders permitted by law shall be approved prior to any changes being made in the approved plans or the actual construction of the facility.

Change orders that would increase the cost of a contract more than $50,000 shall be approved by the Board prior to any changes being made in the approved plans or actual construction of the facility. If the Superintendent determines that such prior approval will unreasonably delay construction on a given project, the Superintendent may approve a change order or a change in the total contract allowance that exceeds $50,000, and the Board shall ratify the change at the earliest opportunity.

Professional Change Orders

The Superintendent is authorized to approve and execute any individual professional change order submitted by design professionals, such as an architect or engineer, that does not exceed $50,000 and does not bring the total of all change orders on a project to an amount that exceeds ten percent of the original contract amount.

Performance and Payment Bonds

For a construction contract in excess of $25,000, performance and payment bonds shall be executed in the amount of the contract conditioned on the faithful performance of the work according to the plans, specifications, contract documents, and payment to all subcontractors. The bonds are solely for the protection of the District in accordance with Government Code, Subchapter B, Sec: 2253.021 Performance and Payment Bonds.
