FDA(LOCAL) - ADMISSIONS: INTERDISTRICT TRANSFERS
The Superintendent or designee is authorized to accept or reject any transfer requests, provided that such action is without regard to race, religion, color, sex, disability, national origin, or ancestral language. In approving transfers, the Superintendent or designee shall consider availability of space and instructional staff and the student's disciplinary history and attendance records.
A nonresident student shall not be permitted to attend District schools except as provided below. A nonresident student shall be any student whose principal place of residence is located outside the geographical boundaries of the District.
Any parent, guardian, or other individual lawfully authorized to act on behalf of a nonresident student desiring to transfer into the District shall file an application for transfer and a transfer agreement with the Superintendent or designee prior to the start of each school year as described below. Transportation shall be the responsibility of the parent or guardian.
A student who does not fall in any of the exceptions indicated below shall be required to pay tuition.
A student who has completed his or her junior year and who becomes a nonresident during the summer may be permitted to transfer back to the District to attend the same District high school for the remainder of his or her high school education. A resident senior who becomes a nonresident during the course of a year may be permitted to continue to attend District schools for the remainder of the school year.
Other students who become nonresidents during the course of the year may be permitted to continue to attend District schools for the remainder of the school year.
A student whose parent or guardian owns property located within the District and pays District taxes on that property may be permitted to attend District schools. Proof of payment of taxes and ownership of property and an affidavit shall be required prior to the student being allowed to start school.
A student who has attended school, whether private or charter, within the District's boundaries during the previous school year and who resides outside of the District may be permitted to attend District schools.
A student whose parent or guardian is employed by a company within the District's boundaries that pays taxes to the District as a business or as a leasee may be allowed to attend District schools if the company has three or more employees, or the company has been in existence for at least one year. An affidavit from the employer evidencing the above shall be required prior to a student being allowed to start school.
A nonresident student who does not meet any of the above-listed exceptions but wishes to attend District schools shall file an application with the Superintendent or designee. Applications for nonresident transfers shall be considered on a case-by-case basis. In approving transfers, the Superintendent or designee shall consider availability of space and staff and the student's disciplinary history and attendance record. School attendance areas for students in high school shall be based on approved geographic boundaries.
To be eligible to remain in the District, a transfer student must abide by all rules and regulations including student conduct, attendance, and testing requirements. In addition, a student must maintain passing grades in all courses.
Schools of Choice
Schools of choice within the District are campuses that provide nontraditional paths to a high school degree as outlined in administrative guidelines. A nonresident student who selects to attend a school of choice within the District boundaries, shall be allowed to attend so long as the student meets campus standards required in academics, attendance, and behavior. After all eligible students, as defined by this policy, are reviewed for acceptance, nonresident students shall be considered for any remaining openings.
Duration of Transfer Approval
Approval of a transfer request shall be for the duration of a student's enrollment at the approved campus. A parent/guardian of a transferred student shall be required to sign a transfer agreement prior to the enrollment of his or her student.
Transfer of Children of District Personnel
District personnel who reside outside the District may request a transfer for their children, on a tuition-free basis, to the District school of their choice. Only one interdistrict transfer per child shall be approved. These transfer students must advance vertically from the campus to which they transferred to the appropriate campus once they are in the school system. The transfer request shall be approved or denied based on the availability of space at the requested campus and grade level. Transportation shall be the responsibility of the employee. These benefits shall become void upon termination of employment with the District.
A student allowed to transfer shall be subject to UIL eligibility rules for participation in UIL activities. It shall be the responsibility of the guardian/student to determine the effect of his or her transfer on his or her UIL eligibility status.
A principal, teacher, coach, or other employee of the District shall not directly or indirectly seek to influence any parent, student, or other person involved in the exercise of the student's application for transfer nor favor or penalize any person because an application for transfer is or is not made.
A transfer student shall be notified in the written transfer agreement that he or she must follow all rules and regulations of the District. Violation of the terms of the agreement may result in a transfer request being revoked.
The Board shall determine annually and within statutory limits the amount of tuition, if any, to be charged. A student who becomes a nonresident during the year and who is permitted to continue in District schools according to the provisions at Transfer Requests, above, shall be required to pay tuition.
The Board may waive tuition for a student upon written application by the student or parent or guardian, upon the recommendation of the Superintendent.
The District may initiate withdrawal of students whose tuition payments are delinquent.
A student who obtained an approved transfer by providing false information shall have his or her transfer revoked at the end of the school year.
Any appeals shall be made in accordance with FNG(LOCAL) and GF(LOCAL), as appropriate.
