GKD(LOCAL) - COMMUNITY RELATIONS: NONSCHOOL USE OF SCHOOL FACILITIES

Scope of Use

The District shall permit nonschool use of designated District facilities for educational, recreational, civic, or social activities when these activities do not conflict with school use or with this policy.

Approval shall not be granted for any purpose that would damage school property or to any group that has damaged District property.

Nonprofit Fund-Raising

The District shall permit nonprofit organizations to conduct fund-raising events on District property when proceeds from the fundraiser benefit District students and when these activities do not conflict with school use or with this policy.

For-Profit Use

The District shall permit individuals and for-profit organizations to use its facilities for financial gain when these activities do not conflict with school use or with this policy.

Campaign-Related Use

Except to the extent a District facility is used as an official polling place, District facilities shall not be available for use by individuals or groups for political advertising, campaign communications, or electioneering, as those terms are used in state law.

Scheduling

Requests for nonschool use of District facilities shall be considered on a first-come, first-served basis.

Academic and extracurricular activities sponsored by the District shall always have priority when any use is scheduled. [See FM] The principal shall have authority to cancel a scheduled non-school use if an unexpected conflict arises with a District activity.

Priorities

Priorities for scheduling the use of school facilities shall be as follows:

The regularly scheduled educational program, including instructional activities; meetings, practices, and performances of school-sponsored groups; and staff meetings related to official school business.

Meetings and other activities of school support groups organized for the sole purpose of supporting the schools or school-sponsored activities [see GE].

Meetings and other activities of groups made up primarily of school-aged children.

Meetings of employee organizations [see DGA].

Meetings and activities of other groups on a first-come, first-served basis.

Approval of Use

The principal is authorized to approve use of facilities by school groups on his or her campus.

The athletic director or designee is authorized to approve use of all athletic and recreational facilities, including unlocked outdoor fields and backstops.

The Superintendent is authorized to approve use of all other District facilities.

Emergency Use

In case of emergencies or disasters, the Superintendent may authorize the use of school facilities by civil defense, health, or emergency service authorities.

Facilities Not Available

The following facilities shall not be available for nonschool use:

Classrooms;

Libraries; and

The black box theatre.

Repeated Use

The District shall permit repeated use by groups or organizations for nonschool purposes no more frequently than four times per year.

Exception

The limitations on repeated use by a nonschool group or organization shall not apply to any group or organization when the primary participants in the activities are District students.

Fees for Use

Nonschool users shall be charged a fee for the use of designated facilities.

The Superintendent shall establish and publish a schedule of fees based on the cost of the physical operation of the facilities, as well as any applicable personnel costs for supervision, custodial services, food services, security, and technology services.

Exceptions

Rental fees shall not be charged for nonschool use by:

Nonprofit organizations when the primary participants in the activities are District students;

School-sponsored or school-support groups.

Groups using school buildings as polling places for public elections, for precinct and county conventions, or for public meetings sponsored by state or local governmental agencies;

District employee professional organizations; and

A District employee for the funeral of a member of the employee's immediate family, as defined at DEC(LOCAL).

If facilities are used by these groups on Saturday, or at such other times as custodians are not regularly on duty, the cost of the custodial service at the hourly rate established for overtime work may be charged to the organization using the facilities. If facilities are used beyond normal business hours, thereby keeping the custodian on duty for an extended period, the additional cost of custodial service may be charged to the organization as well as a charge for utilities.

Use of the District's kitchen facilities shall require employment of one or more District food service personnel. A charge for food service supervision shall apply.

Required Conduct

Persons or groups using school facilities shall:

Conduct business in an orderly manner.

Abide by all laws and policies, including but not limited to those prohibiting the use, sale, or possession of alcoholic beverages, illegal drugs, and firearms and the use of tobacco products on school property. [See GKA]

Make no alteration, temporary or permanent, to school property without prior written consent from the Superintendent.

All groups using school facilities shall be responsible for the cost of repairing any damages incurred during use and shall be required to indemnify the District for the cost of any such repairs.
