BAA(LEGAL) - BOARD OF DIRECTORS LEGAL STATUS: POWERS AND DUTIES

Each ESC is governed by a board of directors. Education Code 8.003(a), 12.104(c)

The board has the legal power and/or duty to:

  1. Develop policies to ensure the sound management and operation of the ESC. Education Code 8.002, 8.003(e)
  2. Adopt policies concerning board election filing procedures. [See BBB(LEGAL)] 19 TAC 53.1001(b)(3)
  3. Approve programs and activities offered to school districts and campuses. Education Code 8.003(e)
  4. Adopt an annual budget for the following year after conducting a public hearing on the ESC's performance during the preceding year on standards established by the Commissioner. [See AE(LEGAL), CE(LEGAL)] Education Code 8.003(f)
  5. Employ an executive director. The selection and dismissal of the executive director is subject to the approval of the Commissioner. Education Code 8.004
  6. Contract, under rules adopted by the Commissioner, for a grant from a public or private organization and spend grant funds in accordance with the terms of the contract. Education Code 8.125
  7. Approve the purchase, lease, or lease-purchase of property [see (LEGAL) policies at CH and CHE]; incur debts for such purpose [see CHA(LEGAL)]; and approve disposal of property [see CI(LEGAL)]. Education Code 8.055
