Compliance with Law
The Executive Director shall establish procedures that ensure that all ESC facilities comply with applicable laws and local building codes.
Prior to advertising or other contracting activity by staff, the Board shall take action to approve the construction project. The Board shall determine the project delivery/contract award method to be used for each construction contract valued at or above $50,000. To assist the Board, the Executive Director shall recommend the project delivery/contract award method that he or she determines provides the best value to the ESC. [See CU series]
For construction contracts valued at or above $10,000, the Executive Director shall also submit the resulting contract to the Board for approval. Lesser expenditures for construction and construction-related materials or services shall be at the discretion of the Executive Director and consistent with law and policy. [See also CH]
The Board may, by resolution, delegate its authority to determine the project delivery/contract award method to be used for construction projects, and to approve and execute a resulting contract, to the Executive Director for a specific period of time, if the Board determines that such delegation will avoid unnecessary delays in the construction contracting process caused by the Board's inability to meet in a timely manner to act under this policy.
Change orders permitted by law shall be approved by the Board or its designee prior to any changes being made in the approved plans or the actual construction of the facility.
All construction projects shall be administered by the Executive Director or designee.
The Executive Director shall keep the Board informed concerning construction projects and also shall provide information to the general public.
The ESC shall not make final payments for construction or the supervision of construction until the work has been completed and the Board has accepted the work.
